01Who we are and what these Terms cover

GoStreak (the "Service") is a habit tracker with companion characters, friends and shared habits. It is provided by GOGOGO LLC, a limited liability company organized under the laws of the State of Delaware, United States ("GoStreak", "we", "us"). The Service includes the GoStreak mobile apps for iOS and Android, the website at https://gostreakapp.com, home-screen widgets and related features.

By creating an account, signing in or otherwise using the Service you agree to these Terms, our Privacy Policy, our Subscription Terms and our Community Guidelines. If you do not agree, do not use the Service.

02Eligibility and your account

You must be at least 13 years old to use GoStreak. If you live in the European Economic Area, the United Kingdom or another place where the digital age of consent is higher than 13, you must be at least that age, or have your parent or guardian's permission. If you are under 18, you confirm that a parent or guardian has reviewed these Terms with you.

• Give accurate information and keep it up to date. One person, one account.
• Keep your sign-in details secret. You are responsible for activity on your account; tell us right away at info@gogogollc.com if you think someone else has accessed it.
• You may sign in with email and password, Sign in with Apple or Google. Those sign-in providers have their own terms.

03The Service

GoStreak lets you create habits, check in daily, build streaks and grow a companion character for each habit. You can connect with friends, join shared habits, send reactions and appear on leaderboards, and some habits can be updated automatically from Apple Health or Health Connect if you allow it.

Some features are free and some require a paid subscription (see the Subscription Terms). We keep improving the Service and may add, change or remove features, including features of paid plans, with reasonable notice where the change is significant. We do not promise that the Service will always be available, error-free or uninterrupted. Features that need the internet will not work offline, and check-ins made offline are synced when your connection returns.

04Your content and profile

You keep ownership of what you create in GoStreak, such as habit names, your display name, bio and avatar picture ("Your Content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and process Your Content only as needed to run, secure and improve the Service for you and the people you choose to share with (for example your friends or the members of a shared habit). The licence ends when you delete the content or your account, except for backup copies that are deleted on a normal schedule and content that other people have already received in the course of the Service.

Parts of your profile (display name, avatar, level and experience points, streak information and, if you set it, your birthday and bio) can be seen by the people you connect with and, for display name, avatar and points, by other users on leaderboards and in friend search. Do not put anything in your profile that you do not want others to see.

You promise that Your Content is yours to share and does not break the law or anyone's rights. We may remove content or restrict accounts that break these Terms or our Community Guidelines.

05Acceptable use

When you use the Service you agree not to:

• break any law, or infringe the rights of others, including their privacy and intellectual property;
• harass, threaten, bully, impersonate or discriminate against anyone, or share hateful, sexual, violent or illegal content;
• upload malware, or try to disrupt, overload, probe or bypass the security of the Service, our servers or other users' accounts;
• access the Service by automated means (scraping, bots) or reverse engineer, decompile or copy the app, except as the law allows;
• cheat or manipulate streaks, experience points or leaderboards with scripts, modified clients or by abusing bugs;
• send spam, unsolicited promotions or mass invitations, or collect other users' information;
• share, sell or transfer your account, or use the Service for commercial purposes without our written permission.

06Friends, invitations and shared habits

You decide who you connect with. When you accept a friend request or join a shared habit, those people can see the information described in the Privacy Policy, such as your name, avatar, streaks, check-ins on shared habits and reactions. Invitation links and codes can be opened by anyone who has them, so share them carefully. Please treat other users with respect and follow the Community Guidelines. You can remove a friend or leave a shared habit at any time.

07Health and wellness

GoStreak is not a medical device and does not give medical advice.

Features that relate to water intake, steps, sleep, meditation or exercise are for general motivation only. They do not diagnose, treat or prevent any condition. Talk to a qualified professional before changing your diet, exercise or sleep, and never ignore professional advice because of something in the app. If you use Apple Health or Health Connect, you control which data GoStreak can read and can change that in your device settings at any time.

08Subscriptions and purchases

The paid plan (GoStreak Plus) is sold through the Apple App Store or Google Play and managed by those stores. Billing, renewal, cancellation and refunds are described in our Subscription Terms, which form part of these Terms.

09Additional terms for Apple App Store users

If you downloaded the app from the Apple App Store, the following also applies. These terms are between you and GoStreak, not Apple.

• Acknowledgement: these Terms are between you and GoStreak only, not Apple. GoStreak, not Apple, is responsible for the app and its content.
• Scope of licence: we grant you a limited, non-transferable licence to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
• Maintenance and support: GoStreak, not Apple, is responsible for support. Apple has no obligation to provide maintenance or support. Contact us at info@gogogollc.com.
• Warranty: if the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price; to the extent permitted by law Apple has no other warranty obligation for the app. Other claims, losses and costs are our responsibility, not Apple's.
• Product claims: GoStreak, not Apple, is responsible for addressing any claims about the app, including product liability, legal or regulatory compliance and consumer protection claims.
• Intellectual property: if a third party claims the app infringes their intellectual property, GoStreak, not Apple, is responsible for the investigation, defence and settlement of that claim.
• Legal compliance: you confirm you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.
• Third-party terms: you must follow the terms of any third-party agreements that apply when you use the app (for example your mobile data agreement).
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce them against you.

If you downloaded the app from Google Play, Google's terms for Google Play apply in addition to these Terms, and Google is not responsible for the app.

10Our intellectual property

The Service, including the GoStreak name and logo, the companion characters, artwork, animations, sounds, text, software and design, belongs to GOGOGO LLC or its licensors and is protected by copyright, trademark and other laws. We give you a personal, limited, revocable, non-exclusive, non-transferable licence to use the app for your own non-commercial use in line with these Terms. All other rights are reserved. If you send us feedback or ideas we may use them without obligation to you.

11Third-party services

The Service works with services run by others, for example Apple, Google, Apple Health, Health Connect and our infrastructure providers listed in the Privacy Policy. We are not responsible for those services, and your use of them is covered by their own terms and privacy policies.

12Ending your use

You can stop using GoStreak at any time and can delete your account in the app (Profile, Account & privacy, Delete Account). Deleting your account permanently removes your data as explained in the Privacy Policy. Deleting the account does not by itself cancel a store subscription; cancel it in the Apple App Store or Google Play settings.

We may suspend or end your access if you break these Terms or the Community Guidelines, if we must do so by law, or if continuing would harm other users or the Service. Where reasonable we will tell you why and give you a chance to fix the problem.

13Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, GOGOGO LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that streaks, points or data will never be lost, although we work hard to protect them. Some places do not allow certain disclaimers, so some of this may not apply to you.

14Limitation of liability

To the fullest extent the law allows, GOGOGO LLC and its members, managers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or streak progress, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim and (b) US $100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, for death or personal injury caused by negligence, or your mandatory consumer rights where you live.

15Indemnity

If your misuse of the Service or breach of these Terms leads to a claim against us by a third party, you agree to cover our reasonable costs of that claim, to the extent the law allows. This does not apply to consumers where it is not permitted.

16Governing law and disputes

These Terms and any dispute about the Service are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Before starting a formal proceeding, please contact us at info@gogogollc.com so we can try to resolve the issue informally within 30 days. If we cannot, the state and federal courts located in Delaware have exclusive jurisdiction, and you and GOGOGO LLC consent to those courts.

If you are a consumer in the European Union, the United Kingdom or another place with mandatory consumer protection laws, you keep the rights those laws give you, including the right to bring a claim in the courts of the place where you live, and nothing in this section removes them.

17Changes to these Terms

We may update these Terms from time to time. If a change is material we will tell you in the app or by email before it takes effect. If you keep using the Service after the new Terms take effect, you accept them. If you do not agree, stop using the Service and delete your account.

18General

If a part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of assets. These Terms, together with the documents they refer to, are the entire agreement between you and us about the Service.
